Fields of law
The legal system is becoming increasingly global amid interpenetration between Roman civil law and common law - for example in the UN Convention on Contracts for the International Sale of Goods. Whether it be commercial transactions, the prohibition of discrimination or criminal law - international relations now characterise many legal transactions and disputes. My lawyer's office is therefore interested in EU-wide and international co-operation. We also represent international clients in our fields of law, and would be glad to communicate with you in English.
My lawyer's office focuses on the following fields of law, which in part are closely interrelated:
Anti-discrimination law
Persons experiencing discrimination include women, people with disabilities, those infected with HIV, transsexuals, hermaphrodites, people without German citizenship, black people, homosexuals, the elderly and many other groups. Legislation in Germany is progressing at a slow pace. Nevertheless those affected now have the opportunity to seek redress - above all by basing their cases on EU Directives. The borderless nature of the internet will be a key anti-discrimination law subject in Germany in 2006. I can represent clients in the field of anti-discrimination law and provide companies with consulting services as to how they can ideally address the pending demands in the German market. I can stage seminars about anti-discrimination law for companies, support them in drawing up contracts and, where necessary, represent them in court.
Disability law
Disability law addresses the wide-ranging legal difficulties that people with disabilities experience in dealings with social services departments, health funds, employers, neighbours or schools. Disability law also addresses human rights and the prohibition of discrimination. In this field my lawyer's office has successfully resolved disputes with employers, integration offices, care insurers and the German Labour Exchange. You can also book seminars in this respect, take advantage of consulting services and as a last resort seek out-of-court and court representation.
Criminal law
Criminal law is such a major, specialist, field that its very nature calls for specialisation. My activities focus on representing people with disabilities or injured parties or those suspected of having committed criminal acts. German law also provides for a so-called "civil action incidental to criminal proceedings" in which victims of crime with the assistance of a victims counsel can represent their interests in court themselves. I also take on cases involving medical criminal law and retainers in media criminal law. For several years now I have specialised in matters involving international and EU criminal law.
Contract law
Contracts are crucial in daily life. Contract law involves the purchase and sale of goods and services as well as rent, leasing or manufacturing products. In German law particular importance is attached to general terms and conditions of business. I provide consulting services for, and represent, private individuals, merchants and medium-sized companies. I can also support clients abroad in respect of drawing up contracts with German contracting parties and represent them in commercial law disputes.
Law of damages
Claims for damages are frequently the result of contracts that have not been executed or have been poorly executed. However, violating other, protected, interests, can also give rise to claims for damages and compensation for pain and suffering. Above all, my lawyer's office deals with claims for damages lodged by people who are disabled as a result of traffic accidents or medical malpractice. In addition to some very high claims for damages, these cases also include claims for compensation for pain and suffering. An additional, key, group of cases involving compensation focuses on faulty products in which use results in injury. These cases frequently require negotiations and involve disputes with insurers. Particular care must also be taken here in respect of the highly complex matters in German law involving periods of limitation.
Media law
Media law covers internet law, press law and the right of publication as well as film and television law. The proceedings in which my lawyer's office normally represents clients out-of-court are concerned with the right of personality and the violation of such rights. However, copyright and service contract laws also play a key part. On occasion, importance is attached to competition and data protection law issues. In addition, I provide consulting services for the media and journalists on media criminal law issues. In this respect I can also draw up an expert appraisals on their behalf, stage seminars and further training events or represent them in court.
Medical law
Medical law is an interdisciplinary field of law in which health funds, physicians, patients, hospitals, pharmaceutical companies and companies producing medical products dispute issues among themselves, but also with third parties. In this respect my lawyer's office focuses on medical liability law and disputes involving aids.
